A write-down of 15 per cent for tax credits already accrued in past years. This is the possible effect of a retroactive application of the obligation to spread the tax credits related to the superbonus over ten years. Although the perimeter of this new squeeze will only be clarified in the coming hours, on the tables of the technicians who are following this delicate matter the potential financial weight of the novelty has already been evident for some time. This explains the protests that have been arriving at the Ministry of the Economy for days now.

The extension over ten years would have the effect of passing on costs to those holding the credits, thus relieving the state's accounts. These extra costs already have a rough quantification. Currently, in fact, on the market a tax credit with recovery in four years is worth, roughly, 85% of its nominal value. Part of the value is lost along the way, because it is necessary to wait a few years before the credit is materially monetised.

If this time is lengthened, the value of the claim drops accordingly. With a recovery in ten instalments, it drops to 70% of the nominal amount. Between the two alternatives, therefore, the same credit is worth 15% less. And it is precisely this figure that banks and companies, but in general all holders of tax credits, risk suddenly losing with the new compulsory credit spreader. Although the government has not yet decided how to move, it is certain that the stakes are very high.

Amendment on controls of municipalities

Together with the credit-spreading game, several other corrective measures will take shape in the coming hours (the executive's amendment is expected tomorrow, 10 May, while the decree will go to the House on Wednesday 15 May). Starting with the one that will involve the municipalities in the controls on superbonus and other tax breaks. After the proposal presented by the Chairman of the Senate Finance Committee, Massimo Garavaglia (Lega), an amendment signed by the executive will arrive on the subject.

It will introduce, as also proposed by the rapporteur of decree 39/2024 Giorgio Salvitti (Fdi), the strengthening of the supervision and control activities of local administrations on these works. This contribution of the mayors will be incentivised with a 50 per cent co-participation fee on the sums collected: in the end, therefore, the government chose a rather high percentage (initially there was even talk of 30 per cent), to stimulate the take-off of a mechanism that does not start with the best auspices. Also in the light of the unsuccessful recent experiences of municipalities' co-participation in qualified alerts for the fight against evasion.

Norm against usury

Still on the abuse front, speaking of tax credits, a rule is also being studied to penalise those situations in which the assignment of the tax credit has configured 'usurious' transactions.

The other pillar of the forthcoming package of changes will concern exceptions. On this point Giorgetti made it clear yesterday that he did not want any more wide-ranging exceptions. Some targeted reopening, however, should come. First of all, on the third sector. The executive will present an amendment to set up a fund with a specific endowment, aimed at recognising third sector entities a direct contribution to support energy and structural requalification on buildings they own. A mechanism, on paper, similar to that already used for the indigent fund.

There is less room, however, on the reopening of the list of regions, affected by earthquakes, in which it is still possible to use the cession. Currently, the possibility is limited to Lazio, Abruzzo, Umbria and Marche. Many parliamentarians would like to extend the list. In order to do so, however, according to the Mef will need specific coverage, which is difficult to find.
