Short-term rentals, from today the new European constraints: what really changes
The new EU regulation on these leases comes into force. However, not everything will be operational immediately
New requirements for short-term rental activities. And, this time, they are not imposed by a regional regulation but directly by Europe, with Regulation No. 2024/1028, in force as of 20 May. This is a text that aims to strengthen the communication of data and information relating to short-term rentals. And which, in some ways, anticipates the forthcoming reforms: the European Housing Plan, expected by the summer, will also contain a new regulation precisely on these activities.
What is already active
The Italian rules have, to some extent, anticipated the set-up imposed by the European regulation. As of 1 January 2025, in fact, a national identification code has become compulsory for properties rented out on a short-term basis. A fulfilment that allows a better traceability of these transactions. In this context, the National Database of Accommodation Facilities and Properties for Short Term Rentals, held by the Ministry of Tourism, allows a more complete monitoring of the phenomenon.
Non-operational novelties
Now the regulation aims to add some elements to this system. Above all, Article 9 of the European regulation introduces the obligation for online short-term rental platforms to transmit activity data and registration numbers. This is, however, not yet operational. It should, in general, cover the activity data for each unit, together with the corresponding registration number provided by the landlord, the specific address of the unit and the Url of the advertisement. However, the technical specifications to activate it have not yet been prepared: the government is working on it.
