The government's Draft Law on Artificial Intelligence is expected on the table of the Council of Ministers, which will meet in the afternoon of Tuesday 23 April. The measure is reportedly on the agenda of the technical preparatory meeting to be held this morning. According to the latest version of the text of the measure on artificial intelligence, within twelve months with one or more legislative decrees the government will have to adapt the national legislation to the recently approved European regulation, the Ai Act.
Among the measures expected on the table of the executive, one concerns the tax sphere: the government is preparing to launch a revision of the income tax regime Irpef and Ires. The instrument is a legislative decree. With the measure, according to learnings, a first implementation of the tax delegation for self-employment income, employee income, agrarian income, and miscellaneous income begins.
Artificial Intelligence: the compromise on copyright protection
Returning to the subject of artificial intelligence, as explained in the Sole 24 Ore of 12 April, a compromise is emerging on the copyright rules. The version that is said to have emerged from a discussion between the Department for Information and Publishing and the Department for Digital Transformation of the Council Presidency states that 'the inclusion' of works protected under the 1941 copyright law 'in datasets or other forms of organisation of data to be used for the training of artificial intelligence models and the use by artificial intelligence systems, including generative ones, are permitted in accordance with articles 70b and 70c'. The first of these two articles of the Copyright Act, 70b, allows research organisations to extract and reproduce texts and data for scientific purposes. The second, 70c, provides for the opt-out mechanism, i.e. the extraction of text and data is allowed when the use of the works and other materials has not been expressly reserved by the right holders. According to the technical experts who worked on it, this formulation reduces the risks of conflict with what are direct competences of the European Commission on the basis of the Copyright Directive and would be in line with the EU Regulation on Artificial Intelligence (Ai Act), indeed anticipating the entry into force of the protections provided for by it.
The Public Fund
.As anticipated in Il Sole 24 Ore of 10 April, the bill envisages a fund of EUR 148 million over two years that will allow the State, through the Department for Digital Transformation and the Cybersecurity Agency, to subscribe shares in Cdp Venture capital funds to support start-ups active in Ia or other frontier sectors such as quantum computing, cybersecurity and 5G.
