Exactly three years ago, on 22 February 2021, the Italian ambassador to the Democratic Republic of Congo Luca Attanasio, his carabiniere escort Vittorio Iacovacci and the World Food Programme driver Mustapha Milambo were killed in an ambush, a dramatic kidnapping attempt in the Virunga National Park area, near the village of Kibumba, near the city of Goma.

A group of local bandits consisting of at least five people, later sentenced to life imprisonment in Congo, blocked the convoy on which the diplomat was travelling. The gang demanded fifty thousand dollars to obtain a 'pass'. Money that was not, however, available to the people on board the jeeps. Hence the kidnapping attempt that ended tragically.

Rome gup: no guilty party in Attanasio's death, trial skipped

For the families of the victims, this year's anniversary is particularly bitter. Indeed, it is very recent - dating back to last week - the decision by the gup of Rome, Marisa Mosetti, to order the non-proceedings for the two officials of the UN agency Pam, Rocco Leone and Mansour Luguru Rwagaza who were charged with manslaughter. The reason? Lack of jurisdiction related to diplomatic immunity. With the Gup's order, therefore, there was a halt to proceedings that had experienced delays due to the 'status' of the two defendants.

The two PAM officials were accused by Assistant Prosecutor Sergio Colaiocco of 'making false statements in order to obtain permission from the local offices of the UN Security Department, indicating in the request for authorisation for the mission, instead of the names of Ambassador Attanasio and Carabiniere Iacovacci, the names of two PAM employees, so as to mislead the offices as to the real composition of the convoy, since they had not submitted the request at least 72 hours beforehand, as required by UN protocols'.

At the end of a council chamber that lasted about an hour, the gup essentially agreed with the position of the Farnesina, which had been summoned to the hearing on 24 January to bring supplementary documentation regarding the way in which the names of employees and officials enjoying immunity were communicated. For the representative of the Ministry of Foreign Affairs, these communications are 'declaratory in nature and not constitutive of functional immunity'. However, the international custom of recognising the immunity of officials linked to the United Nations would prevail. Hence the Gup's decision, leading to the acquittal of the two defendants and the impossibility of proceeding with the trial.

The Public Prosecutor's Office at Piazzale Clodio, sources close to the file have clarified, will pursue all avenues that the criminal justice system provides to ensure that the two Italian citizens and their families' rights are protected.

Who was Luca Attanasio

Born in Saronno (Varese, Italy) on 23 May 1977, Attanasio graduated in business economics from the 'Luigi Bocconi' University of Milan on 18 April 2001. Once he passed the diplomatic competition, he was noappointed probationary Secretary of Legation in the diplomatic career (commercial specialisation) on 29 December 2003. His various experiences include working at the Consulate General in Casablanca as Consul in 2010. In 2017 he was Chargé d'Affaires in Kinshasa, capital of the Democratic Republic of Congo. in 2020 he became Embassy Counsellor. After his death, on 23 February 2021, he was conferred the honorary title of Ambassador in his memory.
