The Supreme Court has declared legitimate the referendum calling for the total abrogation of differentiated autonomy: the law was in fact considered still living, despite the heavy demolishing intervention of the judges of the Constitutional Court. Instead, the question presented by the regional councils that aimed at partial abrogation fell, as the Constitutional Court provided for the abrogation of the points indicated. The Supreme Court's decision is set out in an order of approximately thirty pages. The final word now goes to the Constitutional Court.
Ok Cassation to referendum to repeal autonomy
In its judgement of 3 December last, the Constitutional Court, called to express its opinion on the questions of constitutionality and partially accepting the appeals of four Regions, affirmed, among other things, that "regionalism corresponds to an irrepressible need of our society, as it has gradually structured itself also thanks to the Constitution" and "it is, however, only up to Parliament to compose the complexity of institutional pluralism". And again: "The current constitutional discipline reserves exclusive legislative competence to Parliament in certain matters so that unitary needs are taken care of (art. 117, second paragraph of the Constitution)".
Referendum committee: ahead for total repeal
'We are satisfied, we want to completely repeal this unjust law and from the Supreme Court comes an important confirmation that this referendum can be done. Now we are waiting for the Constitutional Court's pronouncement in January, which will have to rule on total admissibility'. Schlein: governments repeal overhaul
"We believe that after the Constitutional Court's pronouncement that dismantled Autonomy, the government should stop, stop the negotiations and repeal this text, to recover credibility after the blunder they made by presenting a reform that the Court dismantled". Zaia: there is referendum, opposition will have to find votes
