Chatting with a student could lead to a charge of sexual grooming

The Court of Cassation (in judgment 25370/2026) has sent a strong message to the education sector: chats and messages between teachers and pupils can become decisive factors, even in ordering house arrest, when they reveal a pattern of potential sexual grooming.

The case concerns a teacher accused of having entered into an inappropriate relationship with a minor pupil through private communications and of having invited the pupil to his home. The Supreme Court has upheld the precautionary measure, whilst making it clear, however, that this does not constitute a conviction: it will be up to the trial to determine whether the allegations are substantiated.

The decision highlights the delicate balance that must characterise the relationship between teachers and pupils. School is not merely a place of learning, but also an environment founded on trust, educational responsibility and the protection of pupils, particularly where minors are concerned. For this reason, any private communication between a teacher and a pupil requires particular care and must remain consistent with the educational function of the role in question.

The Court also reiterated that, during the investigation phase, the judge must assess the overall strength of the evidence gathered without prejudging the outcome of the trial. Precautionary measures, in fact, serve a preventive and temporary purpose: they are intended to manage situations deemed particularly sensitive whilst further investigations are carried out. The ruling also provides an important opportunity to reflect on the ways in which school relationships develop today. The everyday use of digital tools makes contact between teachers and pupils easier and more immediate, but requires clear rules and an awareness of the boundaries that must be respected. Transparency in communication and the involvement of institutional channels are essential tools for preserving the educational relationship and safeguarding the harmony of the school community.
