Cultural and creative enterprises: the Mimit decree completing the regulatory framework

A decree by the director general of the Ministry of Enterprise and Made in Italy (Mimit) Giulio Mario Donato, published in the Official Gazette no. 171 of 25-7-2025, completes the complex puzzle of the regulation of Cultural and Creative Enterprises (CCI). The act regulates the requirements for registration in the special section of the business register held at the Chambers of Commerce, verification and maintenance of requirements, and revocation.
Let's take a closer look at the decree, which consists of 7 articles envisaged by the Made in Italy Law and subsequent implementing decrees. The Decree contains special provisions regulating the fulfilments necessary for registration in the special section, defining both the technical specifications and the forms to be used for submitting applications. These provisions also include operational instructions for the proper functioning of the section itself.
Fulfillments
.Subjects that meet the objective and subjective requirements provided for by the Interministerial Decree on the terms and conditions for the recognition of the status of cultural and creative enterprise, pursuant to Article 25, paragraph 6 of Law no. 206 of 27 December 2023, registered in the Companies' Register or in the REA and that have declared in the same registers that they carry out creative and cultural activities, submit an application for registration to the Chamber of Commerce. The competent office provides for the registration in the special section if the requirements are met and this entails the recognition of the status of Cultural and Creative Enterprise. The registrar verifies the validity of the information contained in the application for registration, carries out checks to ascertain the validity of the information provided and the continued fulfilment of the requirements for registration. The company's Ateco remains valid as the registrar verifies that the code attributed to the prevalent activity exercised by the entity is included in the list in the annex to the decree. The competent registry office and registrar work together for the registration, the verification of requirements, as well as for the maintenance or possible loss of CCI status. Cultural and Creative Enterprises can cancel their registration in the special section by submitting a special application; the Registrar of Companies orders the cancellation of the Cultural and Creative Enterprise from the special section as a result of the application or for the loss of the requirements. In the second case, the enterprise may submit its observations and documentation to the competent registry office to prove that it still meets the requirements for registration in the special section. The Registrar of Companies is obliged to assess the communications, expressly taking them into account in the final measure of the procedure; cancellation from the special section entails the disappearance of the wording 'Impresa culturale e creativa' and 'ICC', which are removed from the company name, company communications and any other documentation.
In conclusion, it is worth specifying that activities falling under artistic handicrafts are also subject to the artisan activity test.
