Denialism for the post minimising (even indirectly) the Shoah

The Supreme Court clarified, in fact, that the comparison between the true and the untrue evoked by the communication falls within the scope of the rule (Article 604-bis of the Criminal Code), which punishes the propaganda of ideas based on superiority and racial and ethnic hatred, aggravated (paragraph 3) specifically, by negationism. The Court of Appeal had clarified that, by negationism, one means "an attitude of minimisation, scepticism or even rejection of historical truths concerning striking cases of discrimination, often even with the use of violence to the detriment of certain ethnic or religious communities".

It is useless, therefore, to invoke the right to the free manifestation of thought and political opinions. The European Court of Human Rights itself has excluded the protection of the Convention for conduct relating to clearly established historical facts such as the Holocaust 'insofar as it is likely to call into question the values underlying the fight against racism and anti-Semitism'.
