Seven candidates in the upcoming European elections were found to be in breach of the self-regulation code in the checks carried out by the Antimafia Parliamentary Commission. This was announced by the president of the Anti-Mafia Commission Chiara Colosimo during the Commission's plenary session, reporting on the outcome of the traditional checks on the so-called 'unpresentables'.

Out of the 817 nominations reported, the Dna had started with a positive outcome were 20, at the outcome of the Commission's checks, 7 nominations were found to be in breach of the Self-Regulation Code.

Angelo Antonio D'Agostino on trial for corruption

As reported by President Colosimo, Angelo Antonio D'Agostino, candidate to the European Parliament for the list 'Forza Italia Noi Moderati Ppe, Circoscrizione Italia meridionale', 'has been sentenced on 25 March 2016 by the Judge of the Court of Rome for the offence referred to in Articles 319 and 321 of the Italian Criminal Code (corruption for an act contrary to official duties), and the next hearing before the Second Criminal Section of the Court of Rome is scheduled for 26 June 2024'.

Update of 3 June 2024: The defence counsel for the Honourable Angelo Antonio D'Agostino specifies that "the charge of bribery against his client has been dropped, while the charge of forgery remains, and although the statute of limitations, which has now expired for years, D'Agostino is strongly requesting a full acquittal, as he is certain of his innocence, in view of the outcome of the trial inquiry".

Marco Falcone, two indictments

With regard to Marco Falcone, candidate for the list Forza Italia Noi Moderati Ppe, Circoscrizione Italia insulare, 'in July 2023, he was indicted for the offence referred to in Articles 81, 110, 117, 319-quater of the Penal Code (undue induction to give and promise benefits),' Colosimo explained, 'The first degree trial is underway before the Court of Palermo, with the next hearing set for 26 September 2024. For the same candidate, 'on 22 December 2020, an indictment was also ordered for the offence referred to in Articles 56, 81, 110, 317 of the Criminal Code (attempted extortion). The first-degree trial is underway, before the Court of Catania, with the next hearing set for 28 May 2024,' Colosimo stressed.

Alberico Gambino: temporary ineligibility enforced

As for Alberico Gambino, candidate for FdI in the Southern Italy Constituency, "by order of 1 October 2019, the Court of Nocera Inferiore," Colosimo explained, "declared the forfeiture of the aforementioned candidate from the office of mayor of the municipality of Pagani, as the ruling had become final, declaring Gambino's temporary ineligibility, as an administrator who had caused the dissolution of Pagani's municipal council, ordered by the presidential decree of 26 July 2011, pursuant to Article 143, paragraph 1, Tuel,' Colosimo explained, resulting 'in violation of Article 1, paragraph 2, letter c) of the self-regulation code'.

Filomena Greco on trial for disturbing the freedom of choice of contractor procedure

With regard to the candidate Filomena Greco, for the 'United States of Europe' list in the Southern Italy constituency, Colosimo pointed out, 'on 9 January 2024, she was indicted for the offences referred to in Articles 81, 110, 353-bis of the Penal Code (disruption of the freedom of choice of contract procedure) and is currently undergoing trial at first instance before the Court of Castrovillari, with the next hearing set for 21 June 2024'.

Luigi Grillo, the conviction

Concerning the candidature of Luigi Grillo, candidate to the European Parliament for the Forza Italia Noi Moderati Ppe list, North-West Italy Constituency, Colosimo added, "from the certificate of criminal records, it appears that a sentence was issued by the gip of the Court of Milan on 27 November 2014, irrevocable on 19 December 2014, with a sentence of 2 years and 8 months of imprisonment, and with the accessory penalty of the inability to contract with the public administration for 5 years, for the offences referred to in articles: 416, paragraphs 1, 2 and 3, Criminal Code, (conspiracy to commit), committed from September to 2012 and until May 2014; 110, 353, 353-bis, Criminal Code, (disruption of freedom of tenders, disruption of freedom of the procedure for choosing a contractor), committed until March 2014; 110, 319, 321, 353-bis Criminal Code (bribery for an act contrary to official duties, disruption of freedom of the procedure for choosing a contractor), committed from October 2013 and until March 2014; 110, 81, subsection 2, 353, subsections 1 and 2, 353-bis of the Criminal Code (disturbing the freedom of tenders, disturbing the freedom of the procedure for choosing a contractor), committed from September 2012 until February 2014; 110, 319, 321 of the Criminal Code (bribery for an act contrary to official duties), committed from October 2012 until March 2014; 110, 81, subsection 2, 326, subsections 1 and 3 of the Criminal Code (using official secrets), committed from October 2012 until March 2014'.

Antonio Mazzeo: indictment for bankruptcy

The candidature of Antonio Mazzeo, candidate for the Partito Democratico list in the Central Italy constituency, was also in violation of the self-regulation code, Colosimo pointed out. In his regard, he explained, 'on 5 September 2022, the gup at the Court of Rome issued a decree ordering the trial for the offence referred to in Articles 216, 219 and 223 of Royal Decree 267 of 16 March 1942 (fraudulent bankruptcy) and the next hearing before the second criminal section of the Court of Rome is set for 4 July 2024'.

Giuseppe Milazzo: indictment for attempted bribery

Then there is, Colosimo concluded, the candidature of Giuseppe Milazzo, candidate to the European Parliament for the 'Fratelli d'Italia' Circoscrizione Italia insulare list and against him, Colosimo stressed, 'on 22 December 2020, he was indicted for the offence referred to in Articles 56, 81, 110, 317 of the Penal Code (attempted extortion) and the first instance trial is underway before the Court of Palermo, with the next hearing set for 26 September 2024.
