Even if the electronic register is out the rejection remains
In the presence of study deficits, possible dysfunctions of teachers in the use of Classroom are not enough to change the judgement
by Pietro Alessio Palumbo
Key points
The Lazio Regional Administrative Court (judgement 7720/2026) clarified that any dysfunctions in the use of the electronic register and Classroom by teachers - such as omitting the inclusion of homework, study materials and exercises - do not render a rejection illegitimate if the student's insufficient preparation is in any case established.
Facts
According to the family, the lack of management by the teachers had generated widespread confusion among the students and concretely affected their ability to follow the course of study with continuity and to prepare adequately, also in view of the remedial tests. Moreover, the situation had worsened after the father's warnings, who had intervened to urge greater clarity and completeness in digital communication. From that moment on, the teachers had adopted a stricter attitude towards the pupil, a circumstance recalled in order to support an assessment deemed penalising.
The Decision
The Regional Administrative Court, however, downplayed the weight of the critical issues. While not ruling out possible dysfunctions in the teaching organisation, for the judges, these elements alone are not sufficient to invalidate the final judgement. In order to do so, it would have been necessary to demonstrate that the evaluations expressed were manifestly arbitrary, evidence that did not emerge in the concrete case. Digital platforms, therefore, are tools to support teaching, but they do not replace the student's responsibility in studying. Objective verification of the skills achieved remains central.
