Stop spoofing and more protection for users: new rules against phone scams

Agcom introduces technical measures to counter telephone scams and misleading promotions, promoting transparency and user protection.

There is a number ringing on the mobile phone. It could be the bank's. Or anyone else's because it's not blacked out, private. It's a number with an Italian prefix. It sounds like it. Instead, it is a disguise. A deception. A computer trick known as CLI spoofing. So, while the voice on the phone asks for a credit card or bank account number, there is no bank on the other end. There is a scammer. And the scam has already begun.

In 2023, according to data from the Postal Police reported by the Communications Guarantee Authority, more than EUR 140 million ended up in the wrong hands due to this kind of fraud. And that is only the tip of the iceberg.

Now Agcom is trying to react. It does so with a resolution (106/25/CONS) that is intended to be both a self-defence code for users and an operating manual for operators.

Against masked numbers

The measure introduces a number of technical obligations to limit - or at least contain - spoofing. Operators will have to automatically block calls from unassigned numbers. They will have to anonymise those that come from abroad but pretend to come from an Italian landline. They will have to equip themselves with intelligent algorithms capable of recognising abnormal behaviour in real time: hundreds of calls made from the same number in a few minutes, for example.

The resolution provides, in particular, that national operators receiving calls delivered by foreign operators will be obliged to block calls with Italian landline numbers and calls with Italian mobile numbers, unless the user is actually roaming abroad. There are two steps: the first, after three months from the publication of the measure, will concern the blocking of calls from abroad with Italian fixed network caller number; the second, after six months will concern the blocking of calls with Italian mobile network caller number

It is difficult to think that it represents the ultimate solution to the problem. But it is an important step. It needs the cooperation of all network players. Without a systemic response, fraudsters will continue to exploit the cracks in the telephone system, playing on the international routes of VoIP traffic and the inertia of controls.

Reserved offers and data traffic

But there is not only spoofing. Agcom is also intervening to provide clarity on the reserved offers front. Those that arrive by text message, or by phone call, only to certain selected customers. Offers that are always easy to compare with others.

With Agcom's intervention, those offers will have to be described in a transparent manner, accessible online or in shops, with the same level of detail as standard promotions. Another front of the resolution concerns data traffic. Agcom in this case aims to intervene on behalf of all users who have found themselves, without knowing it, with their monthly threshold exceeded and an extra charge in their bill.

Well, when the user reaches 80 per cent of his or her Giga ceiling, he or she will receive a notification. At 100%, the connection will be blocked automatically. And can only be reactivated upon explicit request. No more unwitting slips and suddenly rising costs.

The user between network provider and reseller

Finally, a measure that stems from the concrete experience of many users suddenly left without a line. When a reseller, an operator reselling retail network services, loses access to the network due to disputes with the provider (the so-called wholesale operator), the user can risk being left in the middle. The new rule stipulates that there must be at least one month's notice, clearly communicated, to allow the customer to switch to another operator. An attempt to ensure continuity of service, where today there is often only abandonment.

We are counting on the timely and punctual application of the new rules by telephone operators, in line with what was widely discussed at the technical round table".
