Legitimate rejection if the family was informed in time

The appeal brought by the mother of a pupil who was not admitted to the third year of a language high school for the 2021/2022 school year, following three failures in the final examination, including one in a subject that characterised the course of study, was not upheld by the Regional Administrative Court of Lazio (sentence 16839/2025).

The applicant had contested the lack of timely communication on her son's school progress, as well as the alleged breach of the family's duty of involvement in the management of critical educational issues. She also complained of the absence of a real opportunity to make up for the deficiencies detected.

The capital's administrative judge found the complaint unfounded, considering that the relationship between the school and the family had been correctly managed. In particular, the pupil's customised plan - also signed by the mother - expressly indicated the provision of specific meetings between the teachers, the family and external operators. Moreover, the institute documented that it had offered periodic meetings at the parents' request and had convened the mother from the beginning of the year to inform her of the boy's overall progress.

With regard to the issue of remedial work, it emerged that the student did not participate in the reinforcement activities made available to him, such as weekly workshops and targeted courses. In particular, he did not attend the mathematics course - a subject in which he was insufficient - and only sporadically participated in the French course.

The class council, already in the first semester, had indicated the gaps and the ways to fill them, communicating in writing the remedial needs to the family. The school's decision not to admit the student to the following year was therefore considered legitimate by the Regional Administrative Court, because it was consistent with the didactic evaluation and with a communication process that had guaranteed the family all the useful information and opportunities for discussion.
