The President of the Republic, Sergio Mattarella, signed - pursuant to Article 87(11) of the Constitution - four pardon decrees, on which the Minister of Justice, upon conclusion of the prescribed preliminary investigation, issued a favourable opinion.
The four persons concerned by the pardon decrees signed by the president are: Finotello Gabriele, born in 1991, sentenced to nine years and four months' imprisonment for the crime of voluntary murder of his father committed in February 2021. In granting the pardon that extinguished the entire residual sentence to be served (equal to four years and three months of imprisonment), the Head of State took into account the favourable opinions expressed by the Attorney General and the Surveillance Magistrate, the health conditions of the convicted man and the particular context in which the criminal episode took place, characterised by repeated acts of violence and threats by the victim against his own family members; Zen Massimo, born in 1971, sentenced to a total sentence of nine years and six months' imprisonment for the crimes of voluntary manslaughter and unlawful cognition of communications, committed in 2017. In granting the partial pardon - which extinguished three years and three months of the prison sentence still to be served - the President of the Republic took into account the favourable opinion expressed by the Supervisory Magistrate, the intervening compensation for damages, in the sum agreed with the victim's relatives, and the sentenced man's health conditions. As a result of the measure of the Head of State, the person concerned will still have to serve a sentence of no more than four years' imprisonment, a limit that allows the Surveillance Court to apply the institution of probation to social service (art. 47 of the Penitentiary Order); Attinà Patrizia, born in 1972, sentenced to a total of two years, eight months and twenty days' imprisonment for the offences of theft and extortion, committed in 2012 and 2016. In adopting the act of clemency for the entire residual sentence to be served (two years' imprisonment), the President of the Republic took into account the favourable opinion expressed by the Surveillance Magistrate, the time elapsed since the commission of the offences, the pardon granted by the offended person of the most serious offence and the living and health conditions of the convicted person; Strimbu Ancuta, born in 1986, sentenced to a total term of nine years, seven months and seventeen days' imprisonment for the crimes of extortion and violation of drug legislation. In granting the partial pardon - which extinguished one year and six months of the prison sentence still to be served - the Head of State took into account the favourable opinion expressed by the Supervisory Magistrate, the context in which the offences took place and the family circumstances of the convicted person, as well as the circumstance that Strimbu, before the second sentence became final, was profitably serving her prison sentence on probation to the social service. As a result of the measure of the Head of State, the person concerned will have a sentence of no more than four years' imprisonment left to serve, a limit which allows the Supervisory Court to apply the probation institution to the social service (Article 47 of the Prison Order).
