No to cuts to parity schools for support hours

The case concerned an institute that had reported the presence of two students with disabilities and the need to guarantee an adequate number of support hours for each. The administration had calculated the funding on a lower number of hours, referring in fact to only one pupil. According to the Regional Administrative Court, the school's documentation clearly confirmed the presence of both students and their educational needs. Moreover, the judges pointed out that these elements were consistent with the communications sent at the beginning of the school year. They also considered that the administration did not carry out adequate investigations before reducing the contribution because it merely maintained a standardised approach, without actually verifying the situation of the class.
The Judgment
The decision emphasises how the right to study of pupils with disabilities requires interventions proportionate to actual needs, not to be compressed for organisational or budgetary reasons. The Regional Administrative Court found the school's reconstruction to be correct and ordered the recalculation of the contribution on the basis of the hours actually required for both students, resulting in the right to the payment of the residual sums.
