Question. I would like to know whether the condominium administrator can be satisfied with the viewing of the supporting documents by sending the documentation via Pec (certified electronic mail) or whether the condominium owner has the right to see the original 'supporting documents' in person.
Answer. Article 1130-bis of the Civil Code states that owners of condominiums and holders of rights in rem or of enjoyment over building units may inspect supporting documents at any time and extract copies at their own expense. Each condominium owner, therefore, has the right of access to the condominium documents in question in one, the other, or both modes provided for by the law: vision and/or extraction of a copy. There are no specific case law precedents for cases in which the administrator has provided a copy of the requested documentation, but has refused to allow it to be viewed. The literal tenor of the rule, however, seems to leave no room for doubt on this point.
