Rigopiano, one year and eight months sentence for former prefect Provolo finalised

Appeal bis for six people, managers of the Abruzzo Region at the time, who had been acquitted at the previous trial levels

The sentence of one year and eight months for former Pescara prefect Francesco Provolo for refusing to perform acts of office and forgery has become final. This is what the judges of the sixth criminal section of the Supreme Court decided in the trial for the Rigopiano massacre, when on 18 January 2017 an avalanche swept through the hotel killing 29 people. Appeal bis, instead, for six people, at the time of the events managers of the Abruzzo Region, who had been acquitted in the previous levels of judgement.

The provisional verdict issued by the judges of the sixth criminal section of the Supreme Court on the Rigopiano tragedy reads: "In partial acceptance of the appeal of the public prosecutor, annuls the judgment appealed against Visca Carlo, Antenucci Vincenzo, Caputi Pierluigi, Primavera Emidio Rocco Ernesto, Giovani Carlo and Belmaggio Sabatino in relation to the crimes charged against them under chapters 1) and 2) and refers the case back to the Court of Appeal of Perugia for a new trial against the above-mentioned defendants; rejects the rest of the appeal of the public prosecutor. Upholding the appeals of Lacchetta Ilario, Colangeli Enrico, D'Incecco Paolo and Di Blasio Mauro, it annuls the same sentence in their regard and refers the case back to the Court of Appeal of Perugia for a new trial in relation to the offences charged against them respectively under chapters 4) and 13). It also annuls without referral the same sentence against Bianco Leonardo, limited to the considered aggravating circumstance of the teleological link under Article 61(2) of the Criminal Code, which it eliminates, re-setting the sentence for the crime under chapter 15) at one year, two months and 20 days imprisonment; it dismisses the remainder of Bianco's appeal. Dismisses the appeals brought by the Ministry of Justice, in the person of the Minister pro tempore, and by Provolo Francesco, whom it orders to pay the costs of the proceedings. Declares inadmissible the appeals brought by Di Tommaso Bruno and Gatto Giuseppe, whom he orders to pay each the costs of the proceedings and the sum of EUR 3,000.00 in favour of the Cassa delle Fende.
