The decree, on the other hand, will contain interventions on construction tolerances and partial non-conformities, i.e. minor non-conformities that do not affect the structure of a building, its essential characteristics. The aim, that is, is to allow minor interventions that are not fully legitimate to be remedied, but not to condone abuses. This definition includes all internal modifications to a flat but also, potentially, the enlargement of windows and balconies..

The text works on deviations from the authorised parameters, which are so small that they cannot be considered a building offence, and on interventions that are not excessively heavy and impactful, which do not require any authorisation, permit or communication. A concrete example of this are awnings, also for outdoor use.

Stop work without a permit

The measure will act on buildings constructed before the end of the 1970s (although the precise dates are still being defined), when corrections were often made to what was planned on site. Hence, it will become possible to rectify construction site tolerances that do not compromise stability, such as the building being smaller in size or non-structural architectural elements not being built. The same goes for partial non-conformities, for example windows or balconies: in this case regularisation with a simple sanction is envisaged. There will be no amnesty for essential variations and interventions carried out without permits.
