The Regional Administrative Court of Lazio (ruling 8608/2026) clarified that parents are fully entitled to know and obtain school documents concerning their child's education, especially when it is a student with a disability.
The Story
The decision stemmed from a family's appeal against a Roman comprehensive school that had failed to provide an adequate response to a parental request regarding the individualised educational plan, Glo minutes, and other school documentation. The family had sent the request via Pec in October 2025, asking for a copy of the documents needed to follow their child's school career and verify the inclusion measures adopted by the school. According to the parents, however, the institute had never replied within the time limits required by law.
The School
The school argued in court that it had sent the material by ordinary e-mail, producing a note signed by the school head. For the TAR, however, this was not enough. The judges explained that claiming to have sent an email is not sufficient if there is no concrete proof of actual transmission and receipt by the recipient. In the case examined, neither the sent message nor the delivery receipts had been produced. For this reason, the court annulled the silence-denial formed on the request for access. The judgment reinforces an important principle: parents must be able to know all the acts that affect their children's educational and inclusive path.
