Short-term rentals, national database of facilities goes live

Time is fully respected for the launch of the news on the subject of short-term rentals, an epoch-making reform to which the Minister for Tourism, Daniela Santanchè, expressly refers, identifying the objectives: "Legality, full transparency for users, encouraging the emergence of the underground economy and tax evasion, and a higher quality of services offered to tourists".
With these premises, thanks to a public notice issued by the Ministry of Tourism, the national database of accommodation facilities (Bdsr) and of properties intended for short-term rental or for tourism purposes comes into operation, as envisaged by Article 13-quater, paragraph 4 of Decree-Law 34/2019, converted, with amendments, by Law 58/2019.
Access to the database
.On the telematics portal, it is possible to apply for the Cin, the national identification code, which is linked to the structure and necessary for carrying out the activity. The database can be accessed via digital identity. The second step is the telematic submission of the application certifying the cadastral data of the real estate unit or structure. In regions where a code was already active, the previous code must be indicated in order to issue the new one.
Once the procedure is completed, the user obtains the telematic certification proving the regular issue of the Cin. A quick procedure then, necessary for those who wish to proceed with the short-term rental of their property.
You are given 60 days to obtain the Cin; then heavy fines of up to 8 thousand euro are triggered. You can't go wrong: there are exhaustive Faqs on the Ministry of Tourism website and, until Friday 6 September, a dedicated number: 06.170179245.
Both regional and national codes are displayed
.Browsing through the answers to the questions, important details emerge: the obligation to possess and display the Cin, inside the flat, outside the building and on promotional portals such as Airbnb and Booking, is generalised and has no exceptions. Therefore, those who already have a regional/provincial code must also apply for Cin and display both. Not subject to the Cin obligation are only non-profit religious houses of hospitality, carried out purely free of charge.
Fire extinguishers and smoke detectors in all facilities
.On the safety front, all real estate units intended for short-term rental, managed in any form (entrepreneurial and non-entrepreneurial), must be equipped with functioning combustible gas and carbon monoxide detection devices as well as portable fire extinguishers in accordance with the law.
Building units intended for short-term rental or tourism that are managed in an entrepreneurial form (also pursuant to Article 1, Paragraph 595, Law 178/2020) must also be equipped with the safety requirements of the systems prescribed by the applicable state and regional regulations. Legally prescribed portable fire extinguishers must be located in accessible and visible positions, in particular near entrances and in the vicinity of areas of greatest danger. One fire extinguisher must be installed for every 200 square metres of floor space or fraction thereof, and at least one fire extinguisher per floor.
The role of online agencies
.In a vast and varied tourist offer, a primary role remains that of the Ota, the online travel agencies. The latter, starting with Airbnb and Boooking, recalls Minister Santanchè, 'are aligning themselves and will not propose structures without Cin'.
