Short-term rentals, penalties on the ID code will be triggered in November

In September the national database will be operational, after two months the fines. The obligations will affect all accommodation facilities not only bed and breakfasts

By 1 September 2024, the publication in the Official Journal of the notice attesting to the activation of the national database. Then, two months later, at the beginning of November, the full operation of the entire new system of sanctions, provided for by Decree No. 145/2023 (in Article 13b). After the Ministry of Tourism and the Regions have reached an agreement on the provision, which will set the rules for the interoperability of the national and regional databases (see 'Il Sole 24 Ore' of 27 April), the timetable to which operators will have to pay attention is outlined.
The executive's plan is to start a pilot phase, immediately after the green light for the decree at the State-Regions Conference, to begin experimenting with the transmigration of data from the regional systems to the Ministry of Tourism's national database. Following this phase, by 1 September 2024, the publication in the Official Gazette of the notice attesting to the entry into operation of the database and the ministry's portal is planned.

Sanctions of 500 and 8 thousand euro

This is not just a technical step, because the law states that, 60 days after the arrival of this notice, the new rules on the Unique Identification Code (linked to certain data on the property, including cadastral data) will come fully into force. It means that from November, the package of anti-smuggling rules, designed by this executive at the end of 2023, will be active. Starting with the rule on sanctions. Whoever offers a property for rent without Cin will risk a fine of between 800 and 8 thousand euros. Those who do not use Cin in advertisements will risk a penalty of between 500 and 5 thousand euro.
At the same time, there will also be an obligation to equip oneself with fuel and carbon monoxide detecting devices, as well as portable extinguishers. Although, in this case, the penalty for any failures to comply (up to 6,000 euro) will only be triggered for those who carry out the tourist activity in an entrepreneurial form.

The structures involved

The transmigration of data that is taking shape in these weeks will not, however, concern only bed and breakfasts, but all hotel and non-hotel tourist accommodation establishments, according to the definitions of decree no. 145/2023.
It will be the regions, which have the competence to regulate the matter, that will indicate the exact perimeter of these subjects.

It is, however, a very broad perimeter, which will include hotels, hostels, motels, agritourisms, but also villages, campsites, and mountain refuges. They will all have to be provided with a unique identification code, included in the ministry's national database.
