Support denied: the Regional Administrative Court issues the bill – 2,500 euros to be paid by the school and the Ministry
The administrative courts have made it clear that the right to support is not determined by the number of teachers on the school’s staff, but by the pupil’s needs. And when those needs are ignored, it is the local authority that may end up footing the bill
Il Tar Lazio (sentenza 13960/2026) ha chiarito che il diritto al sostegno non si misura con il numero degli insegnanti che la scuola ha in organico. Si misura con le esigenze dell'alunno. E quando quelle esigenze vengono ignorate, a pagare può essere l'amministrazione. Nel caso deciso dai giudici, 18 ore di sostegno non bastavano: ne servivano 28.
La decisione
Risultato: atti annullati e 2.500 euro di risarcimento alla famiglia. Il Tar ha detto, in sostanza, che il problema non si risolve facendo quadrare l'orario...
