Council of State confirms the legitimacy of school sizing in Campania
Valditara: 'We continue to work to ensure a smooth start to the school year'. The ruling states that: "The preliminary investigation carried out has made it possible to ascertain the groundlessness of the Campania Region's assumptions"
The Council of State, in a ruling in favour of the Ministry, confirming the previous precautionary decisions, definitively upheld the Ministry of Education and Merit's appeal on the subject of school sizing in the Campania Region. The ruling stated that: "The preliminary investigation carried out has made it possible to ascertain the groundlessness of the Campania Region's assumptions"; and further: "Contrary to what the Campania Region assumes, the system described above is therefore in line with the principles set out in the relevant constitutional case law, with sentence no. 233 of 22 December 2023, invoked by the appellant administration as the basis for its assumptions".

Strengthened by the decisions of the Constitutional Court and the Council of State, which have confirmed the full legitimacy of the Administration's actions, we continue to work with determination and commitment to ensure the proper start of the school year throughout the country, always with a view to loyal cooperation with local authorities and ensuring, at the same time, full compliance with the commitments made under the PNRR". Thus stated Giuseppe Valditara, Minister of Education and Merit.
