Sardinia, the Consulta annuls Todde's disqualification: he remains president
This was established by the Constitutional Court in ruling number 148
Alessandra Todde remains president of the Region of Sardinia. There is now some light on the case concerning the disqualification of the Sardinian governor, which comes with sentence number 148 of the Constitutional Court, according to which 'the regional electoral guarantee board has exceeded its powers, causing an impairment of the constitutionally guaranteed attributions of the Region of Sardinia, by ruling on the disqualification of the president of the Region of Sardinia in hypotheses not provided for by law as causes of ineligibility'. The injunction order, which was then sent to the Regional Council, was based on alleged irregularities in the accounting of expenses and in the appointment of the representative.
The judges' findings
The judges of the Constitutional Court noted that the Regional Electoral Guarantee Boards, 'established by Law No. 515 of 1993 to exercise control over the campaign expenses of candidates for the general elections of the two branches of Parliament - control subsequently extended by Law No. 43 of 1995 to the election of the Regional Councils in the Regions with ordinary statutes - are bodies of the State that operate in conditions of independence in order to guarantee the genuineness and authenticity of the will of the electoral body, in conjunction with the freedom of voters to vote'.

La Corte ha poi evidenziato «che le pur gravi fattispecie contestate alla Presidente eletta (tra le quali, la mancata nomina di un «mandatario elettorale», avente il compito di raccogliere i fondi della campagna elettorale, e la produzione una dichiarazione sulle spese sostenute, con relativo rendiconto, caratterizzata da diverse non conformità rispetto alle previsioni di legge) non sono riconducibili a quelle che, in modo esplicito, la legge numero 515 del 1993 ha selezionato come ipotesi di ineleggibilità e, quindi, di decadenza». Con il risultato che «nell’imporre la decadenza al Consiglio regionale, sulla base dei fatti così accertati, il Collegio di garanzia elettorale ha, pertanto, esorbitato dai propri poteri». Poi anche la precisazione che rimane impregiudicata la questione relativa alla possibilità di riqualificazione dei fatti, che è rimessa al giudice civ
In its ruling, the Court also declared inadmissible the conflict promoted by the Region of Sardinia itself against the State on the Cagliari court's rejection ruling.
Todde's reaction
"I learnt the news of the Constitutional Court's ruling from Brussels while I was chairing the Forum of European Island Regions," says Alessandra Todde. "The Constitutional Court recognised that the Electoral Guarantee Board had exceeded its powers, ruling on my disqualification in hypotheses not provided for by law as causes of ineligibility, and had therefore undermined the constitutionally guaranteed attributions of the Sardinia Region.
