Todde case, vote in the Regional Council after the last verdict

The game over the Todde case and his disqualification has just started again. And it brings with it controversy, opposition and a new judicial path. After the decision of the Cagliari Court that rejected the appeal presented by the governor's lawyers, addressee of an injunction of disqualification issued by the Regional Electoral Guarantee College that included, among other things, a fine of 40 thousand euro for alleged irregularities in the accounting of election expenses, there is the new appeal.

The announcement was made by President Alessandra Todde, who emphasised: 'Precisely because we believe in the rule of law, which envisages three levels of judgement, we have the right and duty to defend ourselves in the trial, not from the trial,' she announced. 'So we are going ahead: we are challenging the judgement, because the contested violations do not exist, as the Court of Auditors and the Cagliari Public Prosecutor's Office have also found. The governor then adds: 'Firstly, the Court says that the College of Guarantees was incompetent to rule on the disqualification. So we were right. However, the ruling has several debatable and controversial points, which our lawyers are punctually assessing, but as of now we can see how some passages are inconsistent'. Precisely because 'it is a battle that is fought in the courts', the governor emphasises that 'we will fight it there'. Then a passage on activity, since a series of calls for resignation or even a technical government have come from the opposition. "I am in the middle of my duties,' she continues, 'and I intend to honour them to the end.

"The Regional Council legitimised to continue"

For the President of the Regional Council, Piero Comandini, the Regional Council "while waiting for the competent bodies to pronounce a decision, is legitimised to continue its work in the fullness of its functions". "The Cagliari Court's ruling is only a first degree of judgement," he announces, "which puts President Todde in the position of being able to assert her reasons and the correctness of her work in another degree of judgement.

Before there can be any further developments, however, it will be necessary to wait for the entire process to be concluded.

The ball now passes back to the Regional Council, which, once received, turns it over to the Electoral Council. Here it is very likely that what happened previously will happen, i.e. the possible transmission will be stopped because it is an appeal and not a final decision.

Waiting for the Constitutional Court's decision

Moreover, it will be necessary to wait for what will happen on 9 July when the Constitutional Court will meet to discuss the conflict of attribution raised by the Region against the State with regard to the national law regulating disqualification cases for administrators. That is, it will have to be clarified whether the national law used by the electoral college judges to decree Todde's disqualification in January was applicable to a region with a special statute like Sardinia.
