Two mothers, Turin ready to apply the ruling also for the past

The municipal study office verifies retroactivity, a route that seems possible because the right affirmed by the Consulta applies from birth

The Commune of Turin research office is checking the possibility of applying retroactively the Judgment of the Constitutional Court, which gave the go-ahead to the transcription of the mother's name of intention of the child born in Italy with medically assisted reproduction practised in a country where it is lawful. A route that seems feasible, since the Court has ruled that the right of the child applies from birth. In addition, 'an assessment is also underway as to whether and how transcription can be carried out at the registry office independently by staff from the registry office'.

The announcement came from the Mayor of Turin, Stefano Lo Russo, in his communication to the municipal council on what the first citizen described as 'a politically very relevant fact and a disruptive ruling that affirms as pre-eminent the child's interest in having two parents'. Lo Russo then reiterated that, on the basis of the principles of this ruling, 'it is possible to resume immediatelyregistry transcriptions without having to wait for the legislature', recalling that 'this possibility is currently limited to the case of female couples'. Stressing, finally, that "this judgment clears the field of any ambiguity".

There was no lack of thanks to former mayor Chiara Appendino, who was the first to initiate the practice at a time when Italian municipalities were moving in leopardy, with courage and foresight. "Today,' the mayor concluded, 'we strongly reaffirm that Turin is in the front line in the defence of the rights and equality of children and families'.
