Il contratto collettivo del Comparto è stato quindi firmato alle 14,40 del 27 ottobre e il testo è stato pubblicato immediatamente sul sito dell’Aran in quanto il Ccnl entrava in vigore il giorno successivo. Slimmed text with 69 articles and one annex
The text of the contract consists of 69 articles, an annex, five tables and two joint declarations. It is decidedly leaner than the previous one of 2022 - there were 113 articles - because many clauses have remained unchanged (24 articles from 2022 have survived, with particular reference to disciplinary procedures). A large part of the contract disapplies and replaces previous regulations (41 articles from 2022, 2 from 2018 and 1 from 2001 are disapplied). Finally, a number of clauses are completely new, including the establishment of the socio-educational professional educator and the nursing assistant, additional services, collaborative activities, activities that can be exercised in derogation of exclusivity, some experiments on holidays, age management, and advocacy in case of aggression (19 articles).
Also in this contract, as in all those of recent years, the observations of the MEF were many and quite invasive. Some thirty clarifications were requested, to which the negotiating agency replied punctually and agreed in 4 or 5 cases on the need to make corrections to the text of the Preintesa. Compared to the draft of 18 June, some material errors concerning numbering or cross-references were not corrected.

Un aspetto molto delicato del Ccnl, del quale si è già parlato lo scorso 15 settembre sul sito, riguardava soggetti i abilitati al secondo livello di contrattazione collettiva. La previsione della clausola nazionale (art. 9) sembrava identica al passato, ma nel comma 3, dopo la parola “firmatarie” – in relazione alle OO.SS. di categoria – dal 2022 non c’era più la precisazione ”del presente Ccnl”, potendosi quindi riferire teoricamente ad un “qualsiasi altro“ Ccnl. Per completezza, si segnala che nel Ccnl delle Funzioni centrali del 27.1.2025 – firmato da quattro sigle sulle sette ammesse alla trattativa – il passaggio in questione fa riferimento alle “organizzazioni sindacali di categoria firmatarie del Ccnl triennale”, quindi addirittura una terza formulazione diversa, per la Sanità, da quella del 2018 e da quella della Preintesa del 18 giugno.
