Lazio moves forward: wants to unblock 3.6 billion in building amnesties

With tens of thousands of applications for building amnesty still pending in Lazio, the estimated revenue - according to a study - is approximately 3.6 billion euro, which, if collected, could represent a precious resource for municipalities, allowing targeted interventions to secure the territory and improve the quality of life for citizens. A press conference on the proposed law on the amendment of regional law 12/2004 'Provisions on the definition of building offences' was held this morning in the Tiber Room of the Lazio Region. The speakers were the regional councillor Laura Corrotti, signatory of the bill and chair of the urban planning, housing policies and waste committee, and the councillor for urban planning, housing policies and sea policies, Pasquale Ciacciarelli. Also with them were the regional coordinators and Roman secretaries of the centre-right parties.

What the bill envisages

The proposed law amending Regional Law 12/2004 allows the Lazio Region to take an 'important step towards building regularisation. This is thanks,' it was explained, 'to the removal of a crucial clause, which makes it clear that it complies with the orientation expressed in Law 326/2003. This change follows the path of other Italian regions, ensuring greater consistency in the application of regulations on the subject'. The focus of the bill is on the issue of the sanctionability of building abuses. In fact, there is currently a disparity of treatment for those who have submitted amnesty applications at different times, creating uncertainty and potential injustice in administrative procedures. The removal of the clause is aimed at ensuring a homogeneous application of the jurisprudential principles concerning supervening constraints and the compatibility of the works carried out, ensuring transparency and consistency in the work of the competent administrations.

'An attempt to remedy a blatant injustice: this is the intent of the bill I have filed that aims to remedy tens of thousands of practices blocked by a 2004 regional law. The law in question, which is more restrictive than the state regulations in force, made works in areas subject to constraints that appeared after the application could not be sanctioned,' explains Laura Corrotti (Fratelli d'Italia). "My bill, by removing an aside from the original text, intends to repeal the exclusion from amnesty of works carried out even before the constraint was imposed. In this way,' he continues, 'the injustice suffered by thousands of citizens in Lazio who had already applied for amnesty and in some cases even paid without having been able to regularise their position due to a constraint added at a later date would be remedied. "The bill to amend regional law 12/2004, presented by councillor Laura Corrotti, will make it possible, by overcoming an objective inequality of treatment that has arisen in the field of building amnesties in recent years, to unblock thousands of dossiers, guaranteeing substantial revenue for local authorities," Pasquale Ciacciarelli stressed. "A measure shared as it is considered necessary to solve a need of many citizens who have been waiting for an answer for a long time. We will work together with councillor Laura Corrotti to allow the final approval and entry into force of this amendment as soon as possible,' he concludes.
