Debate on the bar exam starts at the ministry
Meeting between Nordio's staff and Cnf and Aiga scheduled for Tuesday
The debate between lawyers and the Ministry of Justice on the reform of the bar exam has begun. Tuesday 10 March at 12 noon at the ministry for the Cnf and Aiga, the aim being to identify the path and initial contents of the selection of future lawyers. A necessary step after the last Milleproroghe decree, unlike in previous years, did not provide for the preservation of the discipline hitherto envisaged, simplified with respect to the past.
The lapse of the rules under which the last examination (one written and three oral tests) is still being held, the papers being corrected, makes it urgent to determine the number and content of future tests. If the old 2012 law were to be revived, the proportion would be reversed, switching to three written and one oral.
What the reform envisages
The draft delegated law on the reform of the legal system, currently being discussed in the Chamber of Deputies, envisages the introduction of two written tests and an oral test, but the law and delegated rules are unlikely to come into force before the next examination session. Hence the need for a discussion to find a bridging rule or, preferably, new rules that can be anchored.
More balanced access
In the meantime, Aiga expresses satisfaction for next week's appointment, with new president Luigi Bartolomeo Terzo saying he is confident "that an examination structured in two written tests and an oral test can be achieved, which would be a step in line with the proposed reform of the professional forensic law, which envisages the use of codes annotated with case law, and goes in the direction of a clearer, more balanced and sustainable system of access to the profession".
