Pnrr justice, race against time for 48 courts and eight courts of appeal

The Plenum passes resolutions to reach the target by 30 June 2026. Internal call for applications for 500 remote judge posts opens tomorrow

There are 48 first instance courts that will receive the contingent of 500 magistrates to be applied remotely for the elimination of the civil backlog and for the reduction of trial times, the target of the National Reform Programme. Eight, moreover, are the districts of the Court of Appeal that require urgent attention (i.e. graft of lawyers). All this in order not to arrive too long at the deadline - 30 June next - of the verification of the results expected by Europe.

The agenda of the plenum of the Csm, scheduled for this afternoon, delineates with geographic precision the delays on the goal of reducing the duration of civil trials in the three levels of judgement. A photograph that returns, once again, a horizontally striped Italy where - with the sole exception of Venice burdened by citizenship appeals - the red zones are almost exclusively concentrated in the South and the islands.

The Courts of Appeal

The most urgent situations are, in alphabetical order, in Cagliari, Campobasso, Catanzaro, Florence, Palermo, Potenza, Reggio Calabria and Taranto, which will have priority in the assignments. Note of merit, however, for the courts of appeal of Ancona, Bari, Genoa, L'Aquila, Venice - which have achieved the objectives of reducing by 90% the number of proceedings registered b>between 2018 and 2022 and reduced the duration by 40% compared to 2019 - and for those close to the objectives or, in any case, with a "disposition time" (duration) of less than one year: Trieste, Milan, Trento, Sassari.

The cases of Rome and Naples

Also in the red zone are the two judicial universes of the Capital and Naples, which, however, will soon benefit respectively from 66 and 57 Mot (magistrates who have won competitions but are still trainees). Among the recipients of the Mot (25) there is actually also Bologna despite its rating as a virtuous seat, Bolzano should come out of the yellow zone (monitoring) with its forces alone (full staff against 425 sensitive cases) while Brescia, Catania, Lecce, Messina, Perugia, Salerno and Turin are 'close' to the target and in any case have performed better than the national average.

Courts of First Instance

The situation of the first degree offices is more complex, and not only because of the very different starting numbers. Here the deviations from the finish line now less than 300 days away are considerable, so much so that 38 offices are in the full 'red zone', 50% more than the 'green' zones (25), all the rest in the yellow area of careful 'monitoring'. Numbers and (theoretical) distribution aside - for which see the table below - here we appeal to the voluntary availability of ordinary magistrates to apply for the remote management of a minimum of 50 files per capita, also coming from outside the district (thus projecting an absorption/disposal of 25 thousand files in less than 300 days).

Applications should open as early as 9 a.m. on Thursday 4 September and close at midnight on Thursday 18 September, for an effective application that will expire with the NRP, i.e. on 30 June 2026.

The challenge of numbers

The numbers, even before the timing, are challenging because the number of candidates, calculated by the Csm, is only 2609 magistrates: in fact, one judge out of five would have to 'voluntarily' take on an extra product elsewhere, so much so that the call of the Palazzo dei Marescialli is also 'hopefully' addressed to 'magistrates with executive or semi-directorial positions or engaged in criminal functions (perhaps after a previous period in the civil sector)'.

In addition to the judges of the three levels of judgement (but with the Court of Cassation already at its productivity limit), magistrates placed out of tenure who were performing judicial functions at the time of their placement outside the organic role are allowed to participate in the call for applications, but 'magistrates out of tenure in offices located outside the national territory are excluded'.
