Save home: regularising a veranda or room will cost up to 31,000 euro

In addition to smaller irregularities, the decree also regulates more significant discrepancies. For these, a penalty commensurate with the increased value of the property must be paid.

A penalty commensurate with the increased value of the property, up to a maximum of 30,984 euro. Which will be used to regularise situations of heavier non-conformity with the plans filed with the municipality, such as an extra room or a closed veranda. Provided, it must be emphasised, that the situation does not involve a total lack of building permits: complete abuses will not, in fact, be sanctionable. On the scale of non-conformity drawn by the save-home decree, the highest step is reserved for a regulation that revises the conformity assessment, i.e., the procedure that already allows to "bring building abuses back to legality", as explained in the illustrative report accompanying the measure.

Double compliance

Starting from what happens today, in the case of irregularities a work can only be remedied when there is alignment both with the urban-planning and building regulations in force at the time of construction and with those in force at the time the application is submitted. This double stake is the infamous double conformity: a limit that is almost impossible to overcome in most cases. And this leaves many properties in a sort of limbo, making them impossible to sell or even to renovate.

Simplifications

The new rules revise the procedure. Double conformity remains for total abuses, which therefore remain substantially blocked, while a simplification arrives for hypotheses of partial non-conformity with respect to the title filed with the municipality. These are cases such as the closing of a veranda or the construction of an undeclared room.

How much you pay

It will be sufficient, in order to obtain the amnesty, to be in line with the urban planning regulations in force at the time the application is submitted and with the building regulations in force at the time the work is carried out. A building permit in amnesty will have to be submitted or requested, together with which a penalty of between one thousand and 31 thousand euro will have to be paid, commensurate with the increase in the value of the property: these are figures obtained by multiplying the penalties already provided for in the case of an amnesty with double compliance. The single building office of the municipality may, however, condition regularisation to interventions considered essential to ensure compliance with hygiene, safety, energy efficiency or the removal of architectural barriers.
