Yes to the suspension of the lawyer who writes 'nigger' on the opposing party's file
The lawyer had also received the solidarity of General Vannacci, but the Court of Cassation confirmed the two-month suspension from the profession
Key points
Green light from the Supreme Court for the suspension for two monthsfrom practising the profession to the lawyer who identifies the opposing party's file with the word"negro"to indicate a Nigerian citizen. The Supreme Court endorses the disciplinary measure of the National Council of Lawyers. A choice that had led the accused to cry 'professional persecution' suffered for the neutral use of the simple word 'nigger', for the lawyer 'the emblem of an upside-down world'. A quote from the book by General Vannacci who had expressed his solidarity to the 'prince of the forum', collecting a public thank-you, coupled with a commitment to fight through the courts, continuing the battle because 'not bowing down is a duty'.
The injured image of advocacy
The lawyer had also identified a person responsible for his legal troubles. If the disciplinary complaint had been initiated, the 'fault' lay with a magistrate, the father of one of the lawyers who was a party to the trial to which the infamous file referred, who had denounced him because he was "personally, ideologically and professionally distant" from him. The Cnf should, therefore, have considered that there would have been no strepitus fori without the spying. And also without the ideological prejudices, the misunderstood sense of racism and the cancel culture.
But the considerations made by the National Forensic Council, which are shared by the Supreme Court, are of an entirely different nature. Weighing in is the offensive and denigrating character of the word: a boomerang offence that backfires on the category. What the lawyer wrote, in fact, even if not in a professional act, was enough to damage the image of the category, because it contrary to the duties "ofprobity, dignity, decorum and independence by which the lawyer must inspire his or her activity", not only professional but also private. And so the announced legal battle is lost.
