The lack of 'free and present consent' becomes part of the crime of sexual violence: this is a new regulation introduced with a bipartisan amendment unanimously approved by the House Committee on Justice in the examination of the bill to amend Article 609-bis of the penal code on sexual violence and the free manifestation of consent. The amendment was tabled by the rapporteurs, Michela Di Biase of the PD and Carolina Varchi of the FdI, after a negotiation that also involved the leaders of the two parties, Elly Schlein and Prime Minister Giorgia Meloni, in the last hours, as parliamentary sources explained.
What is expected
According to the text, 'anyone who performs or causes another person to perform or undergo sexual acts without the latter's free and present consent shall be punished by imprisonment of from six to twelve years'. The same punishment is provided for "whoever forces someone to perform or undergo sexual acts with violence or threat or by abuse of authority, or whoever induces someone to perform or undergo sexual acts by abusing the conditions of physical or psychic inferiority or of particular vulnerability of the offended person at the time of the act, or by misleading the offended person by substituting himself for another person. In less serious cases, the penalty is reduced by an amount not exceeding two thirds'.
