On the other hand, even a single failing grade is enough for a pupil not to be admitted to the State examination. If, however, the class council decides to let the student sit the examination anyway, a precise burden of justification rests on his shoulders. On the other hand, a student with three failures who has been excluded from the test cannot be readmitted to take the exam. The Tar rejected his appeal, deeming a failing grade in three subjects expressed by a numerical mark sufficient (Tar Milano, judgement 1908 of 19 July 2023).

Lastly, the school is not obliged to identify specific remedial measures for each pupil who reports deficiencies. In fact, it is the families who must take action, once they are made aware of their children's critical points, education being one of the parents' educational duties (Court of Salerno, first civil section, judgment 2461 of 5 June 2023).
