ITALY - Referendum

A confirmatory constitutional referendum on the judicial reform, which envisages the separation of the careers of magistrates and the creation of two Superior Councils of the Magistracy, is expected by spring 2026. The reform, which was approved by the Senate but without the two-thirds qualified majority required to avoid a vote, will then be subject to popular consultation.

Object of the referendum: the constitutional justice reform establishing the separation of careers between judges and prosecutors.

Target: this is a confirmatory referendum, where the outcome will be determined by a majority of valid votes, regardless of whether a quorum is reached.

Timing: the date of the vote will be set by the government on a Sunday between the 50th and 70th day after the call, and the government's aim is to have it held between March and April 2026.

Functioning: the ballot will be simple: 'Yes' to confirm the reform and 'No' to reject it.

Consequences: a 'Yes' vote would mark the end of a long debate and the confirmation of the reform. Should the 'No' vote win, the law would be rejected, with possible political consequences for the government.
